This paper discusses the work of Heleieth Saffioti - The Woman in the Society of Classes - Myth and Reality in two perspectives: First, analyzing the general view of the author who presents in her work elements for a Critical Feminist Theory of the State. This aims to show the lines delimited for a Critical Feminist Theory of the State, with elements for a Theory of Law. Second, discussing the relevance of this theory by critically analyzing the relationship of the legal system with the reproduction of masculine domination in capitalist class society.
