Independence, dependency, and the history of the South

Abstract

A batalha pelo direito internacional durante a era da descolonização foi, em grande parte, uma batalha travada tendo como alvo a natureza, função e objetivos do Estado. Já o ponto final pré-determinado da emancipação política de acordo com a ordem legal de meados do século XX, a tarefa enfrentada pela primeira geração de líderes pós-coloniais, era domesticar, aproveitar e direcionar o Estado para um novo futuro. De forma crucial, e também tragicamente, talvez, suas lutas para este fim foram radicalmente moldadas pelo projeto de desenvolvimento – desta vez, “cria” mais recente da ordem jurídica internacional. O Estado, o desenvolvimento e o direito internacional eram, nesta ordem das coisas, três das principais coordenadas que vieram para organizar a descolonização de povos do Sul. Hoje, várias décadas após o fim do imperialismo formal, ainda estamos lidando com a formação política, econômica, social e administrativa muito particular que resultou desta batalha: o "estado desenvolvimentista".
