O DESLOCAMENTO CONSTITUCIONAL DA COMPETÊNCIA PARA PROCESSAMENTO E JULGAMENTO DE AÇÕES DE ACIDENTE DO TRABALHO PELO DIREITO COMUM

The Constitutional Amendment number 45/2005 changed the article 114,from Federal Constitution, transferring, from common Justice to Justice specialized in work actions, the responsibility to judge actions that dispute indemnity by moral ar patrimonial damage originatedfrom work relations. Due to this, negative c0l1flicts ofiurisdictions emerged between common Justice and Justice specialized in work actions, each one of them claiming the competencefi-om the other to judge the cases that cape with work accidents. Law literature and analytical jurisprudence have not managed to achieve a consensus. This essay analyses this question, conciuding that competence to know and judge such actions is now addressed to Justice specialized in work actions, considering that this change affected immediately aU the judicial proceedings, in whatever stage they are, even the ones already with verdict and in execution stage, because the new law tookfrom common Justice the power to judge this actions.
